How much is a speeding ticket in Idaho?
$90state-set
15 mph over the limit, first offense, ordinary road — the full arithmetic is on this page.
Idaho runs a statewide schedule, so the number printed is the number you pay anywhere in the state — 1-15 mph over: $90 · 16 or more mph over: $155. Those totals already include every mandatory assessment and surcharge, and this page itemizes each one with its statute. For 15 mph over the limit, the all-in figure is $90. What raises it: speeding in a construction zone (i.c. §49-657); speeding in a school zone (i.c. §49-658). Points: Speeding at 1-15 mph over carries 3 points; 16 or more over, or any work-zone speeding, carries 4 points. Every row on this page carries its citation — 3 primary sources (statute text, court fine schedules, DMV publications), each with a retrieval date, plus the local-variation caveat that applies in Idaho. This is a reference to what the law and the schedules print; it is not legal advice.
How Idaho sets it Idaho fixes speeding penalties statewide by court rule: the Idaho Supreme Court's Infraction Penalty Schedule (Infraction Rule 9(b)) sets one fixed penalty per offense plus a standard $56.50 in court costs, and Rule 9 forbids any court from withholding or suspending any part of it. An ordinary speeding infraction costs exactly $90.00 total at 1-15 mph over and exactly $155.00 at 16 or more over, everywhere in the state.
The fine, tier by tier
| Speed over the limit | Base fine | What you actually owe | Citation |
|---|---|---|---|
| 1-15 mph over the limit | $34 state-set | $90 state-set | I.C. §49-654; Idaho Infraction Rule 9(b) Infraction Penalty Schedule (eff. July 1, 2025), item 04(a) The $33.50 fixed penalty plus $56.50 in itemized court costs equals the $90.00 the schedule prints as the 'Total Fine (fixed penalty + court costs)'. |
| 16 or more mph over the limit | $99 state-set | $155 state-set | I.C. §49-654; Idaho Infraction Rule 9(b) Infraction Penalty Schedule (eff. July 1, 2025), item 04(b) Same $56.50 court-cost stack on a $98.50 fixed penalty. This row also carries 4 license points instead of 3. |
- state-set state law or a statewide schedule fixes this number.
- cap only the statute sets a ceiling; the court picks the amount within it.
- court-set no statewide number exists — the local court’s schedule decides.
The mandatory add-ons
Already inside the totals above — this is the arithmetic that turns the base fine into the payment:
| Add-on | How it is computed | Citation |
|---|---|---|
| General fee — other infractions | $16.50 flat per infraction judgment | I.C. 31-3201A(3); Infraction Penalty Schedule fee itemization |
| P.O.S.T. (peace officer training) fee | $15.00 flat per infraction judgment | I.C. 31-3201B; Infraction Penalty Schedule fee itemization |
| Surcharge — other infractions | $10.00 flat per infraction judgment | I.C. 31-3201H(2)(c); Infraction Penalty Schedule fee itemization |
| Court technology fee | $10.00 flat per infraction judgment | I.C. 31-3201(5); Infraction Penalty Schedule fee itemization |
| County surcharge — infractions | $5.00 flat per infraction judgment | I.C. 31-3201(3); Infraction Penalty Schedule fee itemization |
Worked example: 15 mph over the limit, first offense, ordinary road
| Line | Amount | Citation |
|---|---|---|
| Fixed penalty (Speeding 1-15 over, item 04(a)) | $34 | Infraction Penalty Schedule (eff. July 1, 2025) |
| General fee — other infractions | $17 | I.C. 31-3201A(3) |
| P.O.S.T. fee | $15 | I.C. 31-3201B |
| Surcharge — other infractions | $10 | I.C. 31-3201H(2)(c) |
| Court technology fee | $10 | I.C. 31-3201(5) |
| County surcharge | $5 | I.C. 31-3201(3) |
| Total | $90 state-set | lines sum to $90 |
The Supreme Court's schedule prints both numbers: a $33.50 fixed penalty and a $90.00 'Total Fine (fixed penalty + court costs)'. The $56.50 difference is five itemized statutory fees that attach to every infraction judgment. The amount is identical in every Idaho county, and Rule 9 bars courts from suspending any part of it.
What raises it
- Speeding in a construction zone (I.C. §49-657). Charged as its own infraction: $50.00 fixed penalty, $106.50 total with court costs (schedule item 06), and 4 license points regardless of speed. (Infraction Penalty Schedule (eff. July 1, 2025), item 06; IDAPA 39.02.71.100.05)
- Speeding in a school zone (I.C. §49-658). Charged as its own infraction: $100.00 fixed penalty, $156.50 total with court costs (schedule item 07) — the highest speeding amount on the statewide schedule. (Infraction Penalty Schedule (eff. July 1, 2025), item 07)
License points
Speeding at 1-15 mph over carries 3 points; 16 or more over, or any work-zone speeding, carries 4 points.
| Violation | Points |
|---|---|
| Speeding, other than the 4-point cases (in practice, 1-15 mph over) | 3 |
| 16+ mph over, or speeding in a work zone | 4 |
The Idaho Transportation Department suspends the license at 12 or more points in 12 months (30 days), 18 or more in 24 months (90 days), and 24 or more in 36 months (6 months). A one-time 3-point reduction is available for completing an approved defensive-driving class (once every 3 years). (IDAPA 39.02.71.300, .400)
Local variation — the honest caveat
Idaho is one of the most uniform states: the Supreme Court's schedule sets the same fixed penalty and the same $56.50 court-cost stack in every county, and Infraction Rule 9 states that no court has power to withhold judgment or suspend any part of the fixed penalty and costs. Citations written under city or county ordinances rather than the state code sections shown here are outside this table. (Idaho Infraction Rule 9; Infraction Penalty Schedule (eff. July 1, 2025))
- Amounts are from the schedule effective July 1, 2025 (the court's FY-2026 edition); the Supreme Court amends the schedule periodically, usually on a July 1 cycle.
- The two speeding rows (1-15 over, 16+ over) are the schedule's own tiering; Idaho statute does not further subdivide ordinary speeding by mph.
- Idaho has no speed threshold that converts speeding into a criminal charge by itself; offenses like reckless driving are separate charges outside this table's scope.

This is not legal advice This page republishes what Idaho's statutes, court fine schedules, and driver-licensing publications print, for reference. Amounts change on legislative cycles, and the court named on a citation is the authority on what is owed in that court. Nothing here is advice about any citation or case.
